Privacy policies serve the important purpose of allowing individuals to know, understand, and make informed decisions regarding the data that we collect, use, and share. Our goal is to make this privacy policy, which applies to Cunningham Property Management, its related divisions, and its affiliates (hereinafter collectively referred to as “Cunningham”), as easy to understand as possible.

The information we collect can be neatly packed into three categories:

Information Individuals Provide Us:
Certain information is necessary to utilize our services and for us to provide the best experience for our users that we can. While the below categories are by no means inclusive, they give individuals an idea of what information we may collect:

Contacting Us. If an individual contacts us to ask questions about our services, there needs to be a way for us to get back in touch with them. As such, individuals will need to give us information such as their name, email address, and phone number.

Owner Access Accounts. We streamline activities for our users by allowing them to create accounts on our website. In creating their account, users must provide us with specific information in order for us to provide them with the best possible experience.

Payment Information. To purchase offerings provided as part of our paid products and services users will need to provide us with payment information, including their credit or debit card number, card expiration date, CVV code, and billing address.  

Information We Collect When Individuals Use Our Services:
When individuals use our services or access our website, we collect information about how they interact with those services to provide them with information that may be useful to them and to help us to continue to provide the best possible experience through our website, customer service, and otherwise.

Usage Information. We collect information about an individual’s use of our services, including:
– Information on links they interact with across our services(including in our emails sent to them).
– Information about communications between us and an individual, such as through an email or phone call.

Device Information. We collect information about the device an individual uses to access our services, including:
- Information about their connection, such as their IP address and browser type.
– Information about their device and its settings, such as device ID, operating system, carrier, and language.

Location Information. We strive to conduct our business in away that complies with applicable laws in that jurisdiction and to provide relevant information to individuals by collecting their approximate location.

Inferred Identity.
We may collect or receive data that we use to infer an individual’s identity.
– When an individual uses our services on a device, we may use cookies to associate that device and the browser being used to connect it to that individual. For example, to allow them to pick up where they left off or stay logged into their account.
– When an individual provides us with information, such as their email address or phone number, we associate that information with their browser or device. Even when an individual is not signed into their account, we may infer their identity based on the information we collect.

Log Information. We might obtain data when individuals access or engage with our products and services, irrespective of whether they have an account or are logged out, such as: IP address; browser type and language; operating system; the referring webpage; access times; pages visited; location; mobile carrier; device information; search terms; and identifiers associated with cookies. We also receive log information when an individual clicks on, views, or interacts with links on our services.

Advertisements. If an individual observes or engages with advertisements that we provide, we may gather data pertaining to those views or interactions.

Cookies and Similar Technologies. Like most websites, we may use cookies and web beacons to enhance an individual’s experience, gather general information, and track visits to our website. Cookies are text files with small pieces of data that are stored on user’s hard drives and are used to identify their computer as they use a computer network. We do not permit users to opt out of our websites’ use of cookies, although a user’s browser may offer a range of settings that allows them to reject cookies. Web beacons are small pixels that are used to compile aggregate information pertaining to the use of our website and may be seen in some web browsers by clicking on “View” and then “Source.”

Interactions with our content on third-party websites. If an individual accesses our content through third-party websites, we may obtain login formation that includes details about the web page they visited.

Information We Receive from Third Parties:
When utilizing various online products and services, they have the potential to disclose information about an individual’s usage to us.

Ad Partners. We may utilize ad partners who share information about an individual with us such as browser cookie IDs or demographic data. This information may be combined with the other information that we gather as described throughout this policy.

Unaffiliated Third Parties. We may receive information about an individual from parties that we are not affiliated with such as partners who help us evaluate safety and compliance with legal standards.

The information we gather about an individual may be used in a variety of ways to create one cohesive experience.  

To Personalize Our Services
We use the data we collect from an individual to personalize their experience, such as by showing them relevant content and services. We also use this information to measure the effectiveness of various aspects of our website, such as to gauge which pages are viewed most often.  

To Improve Our Services
The information we collect, or that is shared with us, is used to help us improve our services, such as our website and customer service efforts.

To Communicate with Individuals
The information that is shared with us, such as through our contact form or account creation, is used to help us get in touch with individuals about our services. Through combining this information with the other information described in this policy, we can effectively provide only the most relevant information.

To Comply with Safety and Legal Standards
The information we gather is utilized to ensure the safety and security of our users, services, and accounts. This involves verifying a user’s identity, authenticating their account, and safeguarding against fraudulent activities, unauthorized usage, and illegal actions. This encompasses investigating and enforcing our policies, terms, and relevant laws.

Use By Others
Cunningham websites may link to sites we do not operate, and we have no control over how they collect users’ data or liability for their practices, policies and security measures. Users should read privacy notices on those third-party websites before providing any data to them. We are not responsible for the privacy policies and practices of third parties such as social media platforms, site providers or any other app developer or provider, operating system provider, wireless service provider or device manufacturer, or any data users may disclose to them.  

Third-Party Sharing:
We have the possibility of sharing an individual’s information, either fully or partially, with third-party service providers, including but not limited to: (i) companies that handle marketing and sales activities on our behalf, (ii) companies responsible for processing and servicing user’s accounts, (iii) companies that assist us in safeguarding and securing an individual’s information and maintaining the confidentiality of our records, (iv) other companies with whom we maintain a business relationship, and(v) companies who acquire any part of our business, whether by merger, consolidation, or otherwise.  

Non-Affiliated Third-Party Sharing:
On occasion, we may collaborate with other companies to offer co-sponsored or co-branded promotions, products, and services, and we may share information with our co-sponsor. This includes any non-affiliated third parties, including but not limited to: (i) Companies with whom we have established joint marketing agreements; (ii) Non-financial organizations, including direct marketing companies and consumer reporting agencies; (iii) Financial service providers, such as banking institutions, credit card companies, and consumer finance organizations; (iv) Other entities, such as non-profit organizations and third parties with whom we maintain a business relationship. We may share information in other circumstances in which an individual specifically requests their information be shared or gives us permission to do so. Furthermore, if we sell a specific line of business or function, we may also share information as part of that transaction.

When Required by Law:
We may share an individual’s information in situations where we have reason to believe there is criminal or fraudulent activity, as well as when we are legally obligated to do so, such as in response to a subpoena or court order.  

Information we gather from the creation of an account will be kept for the duration of the account’s existence. Information that is gathered in other circumstances will only be kept for as long as is reasonably necessary for our legitimate business purposes, as described throughout this policy, unless a different period is required to comply with legal requirements.

We empower individuals to take control of their data, having implemented reasonable and appropriate physical, technical, and administrative steps to help protect such data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

Revoking Consent:
At any time, an individual can revoke any consent granted to us, as outlined in this policy, for the processing of their information by contacting us through the methods below.

Accessing, Rectifying, or Correcting:
Individuals may access, rectify, or correct their information by making a written request through the contact information provided below. In some jurisdictions, we may be authorized to charge a small fee to cover administrative expenses associated with the request. Also, we may require the individual to verify their identity and provide additional details about their request. Applicable law may allow individuals to request specific pieces of information collected in the prior year and requests regarding how we have handled it. This information may be requested in formats that allow it to be sent to other companies, or the individual may direct us to directly transfer said information.

Deleting Information:
Individuals can reach out to us and request the deletion of their personal information. We will carefully evaluate their request and determine whether we can proceed with the deletion, taking into consideration any applicable legal exemptions or extended retention requirements, as well as any information that needs to be preserved due to an ongoing claim or litigation.

Objections to Processing of Information:
Individuals may also contact us to object to the processing of their personal information or restrict processing of such (such as refraining from selling it or otherwise providing it to any third parties). These requests will be evaluated for justifications for continued processing. If the objection is denied, the individual may appeal our decision by contacting us as outlined below.

Cunningham conducts business on a global scale, and we extend similar privacy tools and controls to all our users, irrespective of their location. Nevertheless, an individual’s experience using our services may vary slightly compared to users in other countries, as we strive to ensure that our privacy practices are fair, transparent, and free from deceptive acts or practices that could harm users or create unfair competition by cooperating with regulatory authorities, especially in relation to consumer privacy and data protection. In the event of any non-compliance with relevant laws, Cunningham will take appropriate steps to rectify the situation and bring our practices into compliance.

Legal Basis to Use Information:
Cunningham does not engage in the sale of any individual’s personal information. If individuals wish to delve deeper and gain a more comprehensive understanding of the intricacies involved, we recommend exploring supplementary information on data processing based on the laws of the jurisdiction in which they are located. This information can be accessed on a variety of websites, including at for those within the United States, or for worldwide regulations.

Moving Data:
If data is shared with a third party, we mandate that they uphold the same level of data protection as we do when handling an individual’s data directly.

Parental Rights:
We are committed to protecting the privacy of children online and our services are not intended for children under the age of 13. We do not knowingly collect personal information from children under 13 without obtaining verifiable parental consent.

Rights Regarding Financial Information:
We may collect and use a user’s personal financial information to provide them with the financial products and services they request. This may include information such as the user’s name, address, social security number, income, account balances, and transaction history. Cunningham does not disclose nonpublic personal information about its customers to non-affiliated third parties except as permitted by law, but it may share the user’s personal financial information with its affiliates. This sharing is done to facilitate transactions, provide the user with requested services, or as required by legal and regulatory obligations. Cunningham may also share information with service providers who assist it in the delivery of its products and services. Cunningham provides users with a clear and conspicuous initial privacy policy that explains its policies and practices, including the types of information it collects and shares. We give users the opportunity to opt-out of certain information sharing with non-affiliated third parties by contacting us using the information in this privacy policy.

Rights Regarding Personal Health Information:
We may collect and use an individual’s Personal HealthInformation (PHI) to fulfill our legal and contractual obligations. This may include information such as medical history, treatment records, test results, and insurance information. We only use and disclose an individual’s PHI as permitted or required by law. Individuals have certain rights regarding their PHI, including the right to access, amend, and request restrictions on the use of their PHI. We will provide individuals with instructions on how to exercise these rights and will accommodate their reasonable requests as required by the Health Insurance Portability and Accountability Act (HIPAA).  

Cunningham makes all reasonable efforts to comply with federal, state, and international laws related to collection, dissemination, and sharing of personal data. This most recent edition of the privacy policy governs the processing of an individual’s personal data, and we reserve the right to update it as necessary.
